Terms and Conditions The following terms and conditions are intended to give a plain English overview. They are not intended to be comprehensive, and further details are provided in our standard Contract of Business.
Copyright: All materials including text and images supplied by the client to WeSolutions will remain the property of the client. It is the client’s responsibility to ensure that relevant licenses and permissions are secured for all content supplied. The copyright for all material provided by WeSolutions including code, images, graphics and text will remain the property of WeSolutions unless otherwise agreed. WeSolutions retains the right to use screenshots of completed websites for inclusion on our website. WeSolutions retains the right to reuse any rejected design ideas for other projects.
Fees: A deposit of 40% is required for all projects before any work is commenced. During the project, all work carried out by WeSolutions in a calendar month will be invoiced at the end of that month. Where a website is to be hosted on a 3rd party web server, WeSolutions requires payment in full for the project before setting the site live.
Payment Terms: All invoices must be paid within 30 days of issue. WeSolutions reserves the right to temporarily remove a website from the internet if an invoice is unpaid after 30 days.
Variations: WeSolutions will complete the project for the price quoted according to the specification agreed at the beginning of the project. Any variations to the specification made by the client will be quoted and charged separately.
Supply of Materials: Where agreed, the client is to supply all materials required to build the website to WeSolutions in a timely fashion. Such materials may include, but are not limited to, page copy, images, graphics and logo.
Third Party Software: WeSolutions may choose to install or integrate third party software products as part of a project. WeSolutions accepts no responsibility or liability for any subsequent loss of service, function or content as a consequence of using third party software products.
Web Hosting: WeSolutions will provide suitable web hosting for a project if required. Hosting is payable annually in advance at the price provided in the quotation.
Domain Names: When instructed, and subject to availability, WeSolutions will register domain names on behalf of a client. Domain names are always registered in the client’s name. Our systems will send reminder emails when a domain name is due for renewal, but the responsibility for renewal remains with the client. WeSolutions reserves the right to refuse to register a domain name where it is considered inappropriate, or to infringe a 3rd party trademark.
Consequential Loss: WeSolutions is under no circumstances responsible or liable for any financial loss or damage caused by the failure of its software. It is the client’s responsibility to ensure that their website and databases are fully backed up.
Search Engine Listings: WeSolutions build search engine friendly websites. However, we do not guarantee search rankings.
Browser Compatibility: WeSolutions will build websites for the latest, most standards compliant browsers (Internet Explorer 7 and 8, Mozilla Firefox, Safari and Opera), and ensure graceful degradation in older browsers (Internet Explorer 6). However, we cannot guarantee forwards compatibility with future browsers.
Approval of Work: On completion of the project, WeSolutions will notify the client, and ask for approval. The client should notify WeSolutions in writing of any points where the work fails to meet the specification within 10 working days. If no issues are reported within 10 working days, the project will be deemed to have been approved. If the project is rejected on the basis of not meeting the specification, WeSolutions will rectify the problems, and resubmit the project to the client for approval.
Terms & Conditions Alterations: WeSolutions reserves the right to amend these terms and conditions at any point and without notice. Updated terms and conditions are available at all times on our website. If any of these terms and conditions are erroneous or unenforceable in law only the specified clause will be disregarded, the remaining terms and conditions will remain in force. If a client chooses to source alternative hosting, WeSolutions will not be liable for any failure in that hosting. Any work that WeSolutions is asked to perform due to third party hosting is chargeable.
